Amendments to IMMEX Regulation, Decrees, HTS, Regulations for Export Permits, PROSEC, Trade Rules, etc.

Mexican Federal Government has recently announced modifications to IMMEX Regulations, Decree Establishing the Import Duty Rate for Goods Originating from North America, Harmonized Tariff Schedule of the General Import and Export Duties Law, Decree Establishing the Import Duty for the Northern Border Region, Decree establishing Sectoral Promotion Programs, Prior Export Permits Applicable to Steel Products and Trade Rules, as follows:

 

IMMEX REGULATIONS:

The Federal Government has updated some provisions in order to be in accordance with the United States, Mexico and Canada Agreement -USMCA-.    In addition, Annex II-B of IMMEX Regulations related to sensitive goods (including but not limited to steel goods classified under chapters 72 and 73) was updated in view of the sixth amendment to the Harmonized Commodity Description and Coding System of the World Customs Organization.

 

DECREE ESTABLISHING THE IMPORT DUTY RATE FOR GOODS ORIGINATING FROM NORTH AMERICA AND SOME OTHER APPLICABLE TO SEVERAL FREE TRADE AGREEMENTS -FTA-:

This instrument reflects the preferential duty treatment applicable under the USMCA and exceptions, including new changes to the Harmonized Tariff Schedule of the General Import and Export Duties Law.   In addition, it was announced the applicable preferential duties treatment and exceptions under FTAs, such as TPP11, European Union, European Association, Japan, Latin America countries, etc.

 

HARMONIZED TARIFF SCHEDULE OF THE GENERAL IMPORT AND EXPORT DUTIES LAW AND DECREE ESTABLISHING THE IMPORT DUTY FOR THE NORTHERN BORDER REGION:

It sets forth changes and new tariff items for chapters 29, 38, 73, 85 and 87 of the HTS.    Moreover, modifications, confirmation and new import duties are announced for steel products and materials of headings 7208, 7209, 7210, 7211, 7212, 7213, 7214, 7216, 7219, 7225, 7226, 7227, 7228, 7304, 7305, 7306, 7307 and 7308 and some other of the HTS, as announced in our Client Alert No. 6 of 2019, with respect to the progressive tariff relief.    Likewise, Federal Government has updated the import duty applicable to goods destined to the northern border region.

 

DECREE ESTABLISHING SECTORAL PROMOTION PROGRAMS:

It was also modified the Decree establishing Sectoral Promotion Programs (PROSEC), through which reduction and exemption of duties are granted to certain materials used to produce goods of several industries.

 

PRIOR EXPORT PERMITS APPLICABLE TO STEEL PRODUCTS AND TRADE RULES:

Regulations governing the procedure to obtain prior permits to export steel products (steel pipelines) was updated in view of the sixth amendment to the Harmonized Commodity Description and Coding System of the World Customs Organization.    Trade Rules were also amended in order to update tariff items subject to Prior Import Permits (including without limitation to steel products).

 

These changes entered into in full force on December 28, 2020.
